Terms of Use
These Terms of Use govern your use of 5MillionPixels.com ("5 Million Pixels," "we," "us," or "the site"). By using the site or purchasing display space, you agree to these Terms.
1. What You Are Purchasing
5 Million Pixels is a public internet experiment that sells digital display space on an online pixel board. Display space is priced at $1 per pixel with a minimum purchase of 25 pixels. Purchases are made in rectangular areas aligned to the site's 5-by-5 pixel grid.
A purchase does not give you ownership of the website, domain name, software, or underlying infrastructure. It gives you the right to submit content for display in the selected area, subject to review and these Terms.
2. Payment and Reservation
Payment is processed through Stripe and any payment methods Stripe makes available at checkout. Space may be temporarily reserved while checkout is in progress. A placement is not final until payment has been successfully completed and the submission has been approved.
3. Review Before Publication
All submissions are reviewed before appearing publicly. We may reject submissions that violate our Content and Moderation Policy, create legal or security concerns, or are otherwise unsuitable for the site.
4. User Content
You retain ownership of content you submit. By submitting an image, animated GIF, display name, text, or other material, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, resize, display, and otherwise use that material as necessary to operate and promote the 5 Million Pixels board.
You represent that you own the submitted material or have all rights and permissions necessary to use it.
5. Links
Approved submissions may include an HTTPS link to third-party content. You are responsible for the destination of that link and for keeping it compliant with our policies. We may disable or remove links that later become unsafe, misleading, illegal, or inconsistent with the approved submission.
6. Display Duration
Our intent is for approved placements to remain displayed for the life of the project, subject to these Terms. We do not guarantee uninterrupted availability, a minimum amount of traffic, clicks, impressions, sales, conversions, or any particular commercial result.
7. Removal After Approval
Approved content may later be hidden or removed if we discover that it violates our rules, infringes another person's rights, creates a security risk, or if the linked destination changes in a way that violates our policies.
8. Refunds
Refunds are handled according to our Refund Policy. In general, submissions rejected during initial moderation will be refunded. Approved and published purchases are generally final except where required by law or where we determine that a refund is appropriate.
9. No Performance Guarantee
Purchasing display space does not guarantee website traffic, advertising performance, search-engine ranking, clicks, customers, sales, publicity, or financial return.
10. Prohibited Conduct
You may not attempt to interfere with the site, bypass payment or reservation systems, access administrative systems without authorization, submit malicious code, abuse the service, or use the site in violation of law.
11. Site Changes and Availability
We may modify, maintain, suspend, or discontinue portions of the site when reasonably necessary. Temporary downtime may occur for maintenance, security, technical issues, or circumstances outside our control.
12. Disclaimer
The site is provided on an "as is" and "as available" basis to the extent permitted by law. We do not guarantee that the site will always be uninterrupted, error-free, or free of third-party interference.
13. Limitation of Liability
To the maximum extent permitted by law, 5 Million Pixels will not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of the site or a purchased placement. Nothing in these Terms limits rights that cannot legally be limited.
14. Eligibility
You must be legally able to enter into this transaction. If you are under the age of majority where you live, you must have permission from a parent or legal guardian.
15. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, except where applicable consumer-protection law requires otherwise.
16. Changes to These Terms
We may update these Terms as the project evolves. The current version will always be posted on this page.
